OrgMetrics Facilitated Dispute ResolutionTM (FDR) is an extension of your partnering process and should be included in your integrated dispute system. FDR has proven to be highly effective in helping teams resolve complex issues. The FDR is a forum for the decision makers to find out the facts surrounding the issues and to resolve the disputes for each issue based on its merits. It provides a forum for the project team to resolve their own issues before sending the issue off to a 3rd party for resolution (e.g. DRB, DRA, Arbitration). We have great belief in the team’s ability to resolve their own issues. Once they know they can resolve a tough issue, they realize they can resolve all of the issues on their project. FDR is an alternative to the traditional “adversarial” approach of our legal system. It is practical, informal, and highly focused on the issues to be resolved. The benefits include:

  • 1. It’s non-adversarial
  • 2. The team gains confidence in their ability to resolve their own issues
  • 3. It is less expensive than DRB, arbitration or litigation
  • 4. There is a high rate of settlement (over 90%)
  • 5. You have more control over the process and outcome
  • 6. Many state laws (e.g. California, Texas) allow for your FDR process to remain confidential
  • 7.  It restores or improves communication
  • 8.  It is faster than DRB, arbitration or litigation

OrgMetrics has experienced, certified facilitators/mediators. We specialize in facilitating dispute resolution for individuals and organizations. Each of the OrgMetrics FDR facilitators is a Certified Dispute Resolution Facilitator (DRF) or a Master Dispute Resolution Facilitator (MDR) from the International Partnering Institute.

Integrated Dispute Resolution Systems

In addition to resolving individual disputes, OrgMetrics can also develop a integrated dispute resolution system for your construction program. Most owners utilize various “claims” processes. These tend to evolve over time, so that there is not integration of the various processes. OrgMetrics helps owners develop an integrated approach to resolving their project disputes. This includes starting with partnering, to prevent disputes, and flows to more formal processes. It also should include the claims process so there is no confusion on the part of the project teams on what the next step is to work to resolve their project issues.
